Naglabas ng pormal na ruling si Presiding Officer Chiz Escudero nitong Lunes, na pumapayag sa kahilingan ng prosekusyon na maglabas ng subpoena para sa mga bank, corporate, at tax records na may kaugnayan kay Vice President Sara Duterte at sa kanyang asawa, Atty. Manases Carpio, kaugnay ng Article 2 ng impeachment complaint.
Ayon kay Escudero, “The Court finds that the requested documents meet the requirements set forth above — they are reasonably described, readily identifiable, and prima facie relevant and material to the allegations under Article 2.”
Binigyang-diin ni Escudero na hindi bago ang pagsusuri sa bank records, at binanggit ang precedent mula sa impeachment trial ni dating Chief Justice Renato Corona.
Pinawalang-bisa niya ang pagtutol ng depensa sa coverage period mula 2007 hanggang 2021, gayundin sa isyu ng magkahiwalay at joint accounts nina Carpio at Duterte.
Kasama sa ruling ang pag-apruba sa subpoena para sa partnership records ng Carpio lawyers, subject to reservation, at ang mga peso-denominated accounts ng 19 corporate entities na iniuugnay sa Bise Presidente.
“The request for subpoenas directed to the concerned banking institutions covering the accounts of respondent Atty. Manases Carpio, separately or jointly, the partnership of Carpio lawyers, and 19 listed corporate entities is granted. The banks are ordered to submit the documents to the Clerk of Court on July 30, 2026 at 9 a.m.,” ani Escudero.
Sa usapin ng tax records, tinanggihan ni Escudero ang argumento ng depensa na ang subpoena ay panghihimasok sa kapangyarihan ng Bureau of Internal Revenue.
Nilinaw niya na ang subpoena ay preliminary at procedural lamang, at hindi awtomatikong nangangahulugan ng paglalabas ng tax records bilang ebidensya. Sa huli, pinayagan ng korte ang subpoena para sa tax records ng respondent. # (ROSE NOVENARIO)
