NAGSAMPA ng kasong genocide ang South Africa laban sa Israel sa International Court of Justice dahil sa digmaan sa Gaza.
Naghain ng aplikasyon ang South Africa sa ICJ upang simulan ang mga paglilitis sa mga paratang ng genocide laban sa Israel bunsod ng digmaan nito laban sa Hamas sa Gaza, sinabi ng korte sa isang kalatas.
Inakusahan ng South Africa ang Israel ng “ violation of its obligations under the Genocide Convention”sa aplikasyon nito at naninindigan na “acts and omissions by Israel … are genocidal in character, as they are committed with the requisite specific intent … to destroy Palestinians in Gaza,” ayon sa ICJ.
Mahigit 21,507 katao ang napatay sa Gaza mula noong Oktubre 7, ayon sa Hamas-controlled Health Ministry ng enclave. Kabilang sa mga namatay ay hindi bababa sa 308 katao na sumilong sa mga silungan ng United Nations, ayon sa United Nations Relief and Works Agency para sa Palestinian Refugees.
Ibinasura ng Israel ang mga pag-aangkin at aplikasyon ng South Africa sa korte ng mundo, sa pamamagitan ng Ministry of Foreign Affairs nito at iginiit na ang South Africa ay “nanawagan para sa pagkawasak ng Estado ng Israel, at ang akusasyon laban sa kanila ay walang factual at legal basis.
Ang aplikasyon ng South Africa ay dumating habang sinabi ng militar ng Israel noong Biyernes na pinalawak nito ang mga operasyon sa katimugang Gaza, kung saan ang mga sibilyan ay sinabihan noon na humingi ng kanlungan.
“South Africa is gravely concerned with the plight of civilians caught in the present Israeli attacks on the Gaza Strip due to the indiscriminate use of force and forcible removal of inhabitants,” sabi sa kalatas ng Department of International Relations and Cooperation ng South Africa.
“Furthermore, there are ongoing reports of international crimes, such as crimes against humanity and war crimes, being committed as well as reports that acts meeting the threshold of genocide or related crimes as defined in the 1948 Convention on the Prevention and Punishment of Genocide, have been and may still be committed in the context of the ongoing massacres in Gaza,” dagdag nito.
“As a State Party to the Convention on the Prevention and Punishment of the Crime of Genocide, South Africa is under a treaty obligation to prevent genocide from occurring.”
Ang South Africa at Israel ay parehong partido sa Genocide Convention, ayon sa ICJ, na kilala rin bilang World Court at ang pangunahing judicial organ ng United Nations. (ZIA LUNA)
