HINILING ng grupo ng mga doktor, nars, health workers at health science students sa Korte Suprema na idiskuwalipika si Judge Cecilyn Burgos-Villabert sa shortlist ng mga kandidato na mapo-promote at maging Associate Justice ng Court of Appeals (CA), Associate Justice sa Sandiganbayan (SB) o ano mang mas mataas na posisyon sa hudikatura.
Sa liham ng Health Action for Human Rights (HAHR) sa Kataas-taasang Hukuman ay nakasaad ang mariin nilang pagtutol sa pagkakasama ng pangalan ni Villavert sa mga kandidatong aangat ang posisyon sa hudikatura dahil ang naturang hukom, bilang executive judge ng Quezon City Regional Trial Court, ang nagbibigay ng search warrants sa Philippine National Police (PNP) kahit hindi pa inaalam ng husto ang pagkakaroon ng “probable cause,” batay sa Supreme Court Administrative Order AM No. 03-8-02.
Ang HAHR ay sumusuporta sa political prisoners sa pamamagitan ng health services, panawagan sa kanilang paglaya,at ang proteksyon ng kanilang batayang karapatan at kapakanan.
Ang gawi ni Villavert, ayon sa HAHR, ay nagresulta sa pagkadakip sa 76 na aktibista batay sa mga gawa-gawang kaso.
“Fabricated evidence were planted to justify the trumped up charges of illegal possession of firearms, ammunition, and explosives,” sabi ng HAHR.
Kabilang sa 76 aktibistang naaresto sa bisa ng warrants na inisyu ni Villavert ay sina Alberto Villamor, 70; Victoria Villamor, 73; at Vicente Ladlad, 75, pawang may edad na at masasakitin pa.
“They are sick and elderly, and we have witnessed their pain and suffering during the 5 years of being deprived of liberty and adequate medical attention,” wika ng grupo.
Malinaw anilang ebidensya ito na inabuso ni Villavert ang kanyang posisyon.
Binigyan diin ng HAHR na karamihan sa inisyu na search warrants ni Villaavert ay ibinasura kalaunan ng Regional Trial Courts (RTC) at Court of Appeals (CA).
Sa kaso ni Reina Mae Nasino et al., idineklara ng Supreme Court na ang search warrants ginamit laban sa kanila’y walang bisa bunsod nang pagkabigong tukuyin ang lugar na hahalughugin.
The search warrants issued against Mr. Velasco, Ms. Salem, Mr. Esparago, and the Bacolod activists were all declared invalid for exactly the same reason. To date, seven (7) out of seventy-six (76) activists arrested due to warrants issued by Villavert are still undergoing trial. Fifty-seven have either had their cases dismissed after the quashal of the Villavert-issued search warrant or were acquitted after trial,” sabi ng HAHR.
“We are appealing to this Honorable Council for the immediate disqualification of Judge Cecilyn Burgos-Villavert for any higher position within the judiciary. Based on aforementionrd cases, there are serious questions and doubts on Judge Villavert’s competence, integrity, probity, and independence in adhering to the highest commitment to uphold the rule of law and to protect the rights of all citizens without fear or favor, especially the most vulnerable.” (ZIA LUNA)
