TILA kahalintulad ng pamosong anomalyang naganap sa panahon ng pandemya ang kontrobersyal na P206-M contract na ipinagkaloob ng Philippine Charity Sweepstake Office (PCSO), sa joint venture ng Intercontinental Broadcasting Corporation (IBC-13) at Digital 8 Inc. para sa pag-ere ng lotto draw at iba pang games sa IBC-13.
Tadtad ng misteryo, kaduda-duda at walang indikasyon kung paano nagkaroon ng puhunan ang Digital 8 upang tustusan ang JV nito sa IBC-13 gayong P130,000 lamang ang paid-up capital ng kompanya.
Nakorner ng Digital 8 ang JV sa IBC-13 sa panahong ang “authorized representative” ng kompanya ay si Jay Ruiz na ngayo’y acting secretary ng Presidential Communications Office (PCO).
Ang IBC-13 ay isang attached agency ng PCO.
Sa itinakda ng Commission on Audit (COA) na Joint Venture Guidelines hinggil sa pagpasok ng ahensya ng pamahalaan sa joint venture agreement, kailangan magbuo ang IBC-13 ng Joint Venture Selection Committee para sa pagpili ng private partner nito sa panukalang joint venture.
Sa kapital na P130,000 ng Digital 8, ano ang naging batayan ng IBC-13 para piliin ang pribadong kompanya na isagawa ang P206-M project ng PCSO?
Ayon sa Eligibility Requirements ng JV Guidelines ng COA:
“c. Financial Capability. The Government Entity shall determine before evaluation of eligibility, the minimum amount of equity needed for the JV activity.
The following documents shall be submitted by the prospective JV Partner:
- Audited financial statements for the past three (3) calendar years. If the prospective JV Partner is Filipino, the audited financial statements to be submitted must be stamped “received” by the Bureau of Internal Revenue (BIR) or its duly accredited and authorized institutions; and
- Latest tax returns, if the JV Partner is Filipino. “
Habang ang “ Financial capability shall be measured in terms of:
- i) proof of ability of the prospective JV Partner to provide a minimum amount of equity to the JV activity, measured in terms of the net worth of the company, or a deposit equivalent to the minimum equity required set aside or ear-marked for the proposed JV activity; and
- ii) a letter from a domestic universal/commercial bank, or an international bank with a subsidiary/branch in the Philippines, or any international bank recognized by the Bangko Sentral ng Pilipinas (BSP), attesting that the prospective JV Partner is one of its current clients, and is in good financial standing.”
Sa kabila ng mga pag-uungkat sa pinasok nitong JVA sa Digital 8, hanggang sa ngayon ay tikom ang bibig ni IBC-13 President and CEO Jimmie Policarpio.
Ano kaya ang mga dokumentong isinumite ng Digital 8 kaya pinaboran ito ng IBC-13?
Matatandaan sa nabulgar na anomalya noong COVID-19 pandemic ay nabisto na hindi rehistrado sa Bureau of Internal Revenue (BIR) ang Pharmally Pharmaceutical Corporation base sa pahayag ni Sen. Franklin Drilon na wala itong tax clearance pero nakasungkit ng P10-B halaga ng medical supplies sa administrasyong Duterte.
Giit ni Drilon, para makasali sa government bidding ang isang kompanya ay kailangan makakuha ng tax clearance mula sa Bureau of Internal Revenue (BIR).
Ngunit walang record aniya na may tax clearance ang Pharmally.
Bukod sa tax clearance, binusisi ng Senado kung nagbayad ng tamang buwis ang Pharmally at kung saan sumikwat para pondohan P10 bilyon halaga ng medical supplies contract na ipinagkaloob sa kompanya ng Procurement Service- Department of Budget and Management (PS-DBM) sa ilalim ni dating Undersecretary Lloyd Christopher Lao, gayon P625,000 lamang ang paid-up capital nito.
Sa masusing imbestigasyon ng Senate Blue Ribbon Committee, natuklasan na ang padrino ng Pharmally ay si Michael Yang, dating presidential economic adviser ni dating Pangulong Rodrigo Duterte.
