Tinuligsa ng Court of Appeals (CA) ang kapabayaan ni Philippine National Police Chief Gen. Nicolas Torre III at apat pang opisyal kaugnay sa sapilitang pagkawala ni Felix Salaveria Jr., 66-anyos, aktibista mula sa Bicol, noong Agosto 28, 2024.
Sa desisyon ng CA, binigyang-proteksyon din ang mga anak ni Salaveria sa pamamagitan ng mga writ ng amparo at habeas data.
Sa 62-pahinang desisyon ng dating 13th Division ng CA, sinabi ng hukuman na nabigo ang mga opisyal , kabilang si Torre, na noon ay direktor ng Criminal Investigation and Detection Group, na ipamalas ang “extraordinary diligence” sa imbestigasyon.
“Evidently, the lack of a prompt and thorough official inquiry into the allegations made by petitioners indicate a laxity of the required diligence on the part of respondents,” ayon sa desisyon na iniakda ni Associate Justice Mary Josephine Lazaro.
“This court simply cannot write finis to this case on the basis of an incomplete investigation conducted by the police and the military. In a very real sense, the right to security of Felix is continuously put in jeopardy because of the deficient investigation that directly contributes to the delay in bringing the real perpetrators before the bar of justice,” dagdag nito.
Makikita sa CCTV ang sapilitang pagdukot kay Salaveria noong Agosto 28, 2024, sa Barangay Cobo, Tabaco City, habang pilit siyang isinakay sa kulay abong van ng mga hindi pa rin nakikilalang salarin. Limang araw bago ito, nawawala rin ang kanyang kaibigan at kapwa aktibista na si James Jazmines.

– Police Brig. Gen. Andre Perez Dizon**, Regional Director ng PRO V
– Police Col. Julius Añonuevo**, Provincial Director ng Albay
– Police Col. Ivy Castillo**, Hepe ng CIDG Regional Field Unit 5
– Police Lt. Col. Edmundo Cerillo Jr., Hepe ng Tabaco City Police Station
Iniutos ng CA sa PNP at National Police Commission ang isang “seryoso, epektibo, at masinsinang” imbestigasyon, at pagpreserba ng ebidensyang dapat isalin sa Commission on Human Rights at iba pang kinauukulan.
“Hopefully, if the respondents comply fully, this could lead to the surfacing of Felix,” pahayag ni Atty. Ben Galil Te, abogado ng pamilya ni Salaveria
“Even as the State continues to evade responsibility and hide the truth, our clients are determined to pursue justice—not only to surface Felix but to hold all those involved accountable, even those in the highest levels of government,” aniya. (ROSE NOVENARIO)
