NAGLABAS si Pangulong Ferdinand “Bongbong” Marcos Jr. ang isang executive order at ilang proklamasyon na nagbibigay ng amnestiya sa mga rebelde upang maengganyong magbalik-loob sa pamahalaan.

Sa Executive Order (EO) No. 47, na nilagdaan ni Executive Secretary Lucas P. Bersamin noong 22 Nobyembre 2023, ay inamyendhan nito ang Executive Order No. 125, series of 2021, o ang pagbuo ng  National Amnesty Commission (NAC).Anang Pangulo, may pangangailangan para amyendahan at i-update ang functions ng National Amnesty Commission upang masaklawa ang pagproseso ng mga aplikasyon ng para sa amnesty sa ilalim ng mga bagong proklamasyon.

“There is hereby created the National Amnesty Commission, hereinafter referred to as the Commission, which shall be primarily tasked with receiving and processing applications for amnesty and determining whether the applicants are entitled to amnesty under *Proclamation Nos.  403, 404, 405 and 406*,” ayon sa EO.

Patuloy ang gagampanan ng komisyon ang tungkulin ayon sa EO No. 125 at bubuwagin na ito kapag natapos na ang kanilang mandato o depende sa determinasyon ng Pangulo.

Sa ilalim ng Proclamation No. 403, ginagawaran ni Marcos Jr. ng amnesty ang mga miyembro ng Rebolusyonaryong Partido ng Manggagawa ng Pilipinas/Revolutionary Proletarian Army/Alex Boncayao Brigade (RPMP-RPA-ABB) na nakagawa ng mga krimen na may katumbas na parusa alinsunod sa Revised Penal Code at special penal laws, lalo na ang mga krimen ginawa sa pagsusulong ng political beliefs, kahit  may katumbas na parusa sa ilalim ng RPC o special penal laws.

Ngunit hindi sakop ng Proclamation ang kidnap for ransom, massacre, rape, terrorism, crimes committed against chastity  batay sa RPCas defined in the Revised Penal Code, mga krimen na ginawa dahil sa personal agenda, paglabag sa Republic Act (RA) No. 9165, o ang Comprehensive Dangerous Drugs Act of 2002, grave violations ng Geneva Convention of 1949, at genocide, crimes against humanity, war crimes, torture, enforced disappearances, at masahol na paglabag sa human rights.

Inisyu rin ni Marcos Jr. ang Proclamation No. 404 na naggagawad ng sa mga dating miyembro ng Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP-NPA-NDF) na Nakagawa ng krimen na may parusang nakasaad sa RPC at Special Penal laws habang isinusulong ang kanilang paniniwalang politikal.

“It stated that amnesty is granted to former CPP-NPA-NDF members, or their front organizations that committed crimes whether punishable under the Revised Penal Code or special penal laws, including but not limited to rebellion or insurrection; conspiracy and proposal to commit rebellion or insurrection; disloyalty of public officers or employees; inciting to rebellion or insurrection; sedition; conspiracy to commit sedition; and inciting to sedition,” sabi sa kalatas ng Presidential News Desk (PND).

Kasama rin ang ilang paglabag gaya ng “illegal assembly; illegal association; direct assault; indirect assault; resistance and disobedience to a person in authority or the agents of such person; tumults and other disturbances of public order; unlawful use of means of publication and unlawful utterances; alarms and scandals; illegal possession of firearms, ammunition or explosives, provided that these crimes or offense were committed in furtherance of, incident to, or in connection with the crimes of rebellion or insurrection.”

Saklaw rin ang mga kinasuhan, ikinulong o nahatulang guilty sa common crimes kapag makapaglalabas ng mga ebidensya na nagawa nila ang mga naturang krimen sa pakikibaka para sa kanilang political beliefs.

Ang amnesty na iginagawad sa ilalim ng Proclamation ay hindi kasama ang” kidnap for ransom, massacre, rape, terrorism, crimes committed against chastity as defined in the Revised Penal Code, violation of RA No. 9165, otherwise known as the Comprehensive Dangerous Drugs Act of 2002, grave violations of the Geneva Convention of 1949, and genocide, crimes against humanity, war crimes, torture, enforced disappearances, and other gross violations of human rights.”

Inilabas din ni Marcos Jr. ang Proclamation Nos. 405 and 406, na nagbibigay ng amnesty sa lahat ng mga kasapi ng Moro Islamic Liberation Front (MILF) at Moro National Liberation Front (MNLF), respectively, na nakagawa ng krimen na may parusa ayon sa RPC at Special Penal Laws habang isinusulong ang kanilang paniniwalang politikal.

“Any member of the MILF and MNLF who has committed any act or omission in pursuit of political belief, referred to in Section 1, including those detained, charged, or convicted for such acts or omissions, may file an application for amnesty; provided that the crime for which amnesty may be granted must have been committed prior to the issuance of the Proclamation.” (ROSE NOVENARIO)
