DEKLARADO na sa batas ang proteksyon at katiyakan sa kapakanan ng mga manggagawa sa industriya ng pelikula at telebisyon.

Nilagdaan ni Pangulong Ferdinand “Bongbong” Marcos Jr. ang “Eddie Garcia Law” o ang Republic Act 11996, ang batas na nag-ugat sa pagkamatay sa aksidente sa set ng isang pelikula ng beteranong actor na si Eddie Garcia.

Alinsunod sa batas, magpapatupad ng “work hours, wages and other wage-related benefits, social security and welfare benefits, basic necessity, health and safety, working conditions and standards, and insurance.”

Ang pagbibigay proteksyon sa mga obrero sa pelikula at telebisyon ay dapat naaayon sa “Labor Code of the Philippines o Presidential Decree No. 442 as amended, and Republic Act No. 11058 or the “Act Strengthening Compliance with Occupational Safety and Health Standards and Providing Penalties for Violations” and other applicable laws.”

Binigyan pansin sa batas ang nangyaring aksidente na naging sanhi ng pagpanaw ni Garcia habang nasa shooting ng isang pelikula.

Itinatakda sa batas na ang manggagawa at employer o principal na magpapatupad ng kasunduan o isang employment contract sa lengguwahe o wika na maiintindihan ng magkabilang panig bago maibigay ang serbisyo.

“No agreement or employment contract shall discriminate against a worker who has contracts or projects with other production outfits unless exclusivity is specified in the contract, nor shall any person perform any act involving preference based on race, color, descent, national or ethnic origin, or religion, which has the purpose or effect of nullifying the recognition, enjoyment, or exercise on an equal footing of any human right or fundamental freedom,” ayon sa non-discriminatory provision ng batas.

Kaugnay sa oras-paggawa, nakasaad na ito’y dapat nakabatay sa terms and conditions na nakalagay sa “agreement or employment contract and other stipulations signed with the employer or principal.”

Habang kaugnay sa sahod,” the minimum wage of a worker shall not be less than the applicable minimum wage in the region where the worker is hired and wages shall be paid on time, as agreed upon in the contract, directly to the worker.”

Kailangan sundin ang employer o principal ang mga probisyon sa Republic Act No. 7610 na inamyendahan ng Republic Act No. 9231sa pagkuha ng mga menor-de-edad  bilang mga empleyado.

Lahat ng manggagawa ay kailangan mapagkalooban ng mga benepisyong mula sa Social Security System (SSS), Home Development Mutual Fund or Pag-IBIG Fund, at Philippine Health Insurance Corp. (PhilHealth).

Upang matiyak ang kalusugan at kaligtasan ng mga obrero, itinadhana sa batas na ang employer o principal ay dapat sumunod sa occupational safety at health standards batay sa itinakda sa Republic Act No. 11058 at Section 25 ng Republic Act No. 11036.

“The law also calls for continued upskilling and reskilling of workers. It directs the Technical Education and Skills Development Authority (TESDA), in collaboration with relevant government agencies and various stakeholders, to develop and implement a system of continuing skills upgrading, reskilling, and training of workers in the movie and television industry,” ayon sa kalatas ng Presidential Communications Office (PCO).

Sinoman ang lalabag sa batas ay papatawan ng multang P100,000 para sa first offense; hanggang P200,000 para sa second offense; at hanggang P500,000 para sa third and succeeding offenses.

“If the violation is committed by a corporation, trust or firm, partnership, association or any other entity, the fines shall be imposed upon the entity’s responsible officers, including, but not limited to, the executive producer, producer, production manager, and business unit manager.” (ROSE NOVENARIO)
