“Doble Kara” effigy

IBINASURA ng Quezon City Prosecutor’s Office ang mga kasong isinampa ng pulisya laban sa mga miyembro ng Bagong Alyansang Makabayan (Bayan) kaugnay sa pagsunog sa effigy noong ikalawang State of the Nation Address (SONA) ni Pangulong Ferdinand “Bongbong” Marcos Jr noong Hulyo 2023.

Sinabi ng Movement Against Disinformation (MAD, na ito’y isang “significant legal victory” para sa akusadong si Max Santiago, isang respetadong visual artist at cultural worker, na inasunto dahil sa sining na kanyang nilikha, ang “Doble Kara” effigy na kumakatawan kay Marcos Jr. na ang isa’y itinampok ang kanyang mga pangako noong kampanya at ang isang mukha ay may hawak siyang baril at money bag na sumisimbolo sa mga isyu ng human rights violations at resource management.

Kabilang sa isinampang kaso kay Santigao ay paglabag sa environmental laws na ibinasura sa kawakulangan ng ebiedensya at kuwestiyonableng batayang legal.

“After due and careful consideration and the evidence on record, this Office finds no probable cause to charge the Respondents for the crime of Violation of Section 48, paragraph 3 of Republic Act No. 9003 otherwise known as the ‘Ecological Waste Management Act of 2000’ and Violation of Republic Act No. 8749 otherwise known as ‘The Clean Air Act of 1999,” ayon sa resolution.

“This decision marks a critical moment in upholding the right to free expression and combating baseless legal harassment. The prosecutors’ refusal to pursue charges without substantial evidence is a testament to the integrity of our legal system and the importance of protecting democratic principles,” sabi ng MAD.
